The decree that encourages the investment of taxpayers who carry out productive economic activities within the Development Poles for the Well-being of the Isthmus of Tehuantepec states that a 100% discount on ISR will be granted during the three fiscal years, to companies , whether physical or legal persons, after obtaining a certificate as operators in this corridor.
This will be issued by the SHCP and must be approved by the general director of the Corridor, with the objective that they meet requirements such as being up to date with their tax obligations, having a valid concession title or being the owner of some area within a Pole; Present the investment project for which the concession title was granted, and have a tax domicile in the pole where they develop their productive economic activities.
After the first three fiscal years, a discount of 50% of the income tax will be granted in the three subsequent fiscal years, or up to the equivalent of 90% in the event that the minimum levels of employment are exceeded, refers to the decree.
On his Twitter account, the Undersecretary of the Treasury, Gabriel Yorio, reported that VAT exemption is also offered for operations within and between the Poles, in addition to accelerated depreciation of investments for a period of 6 years.
In addition, the recovery of VAT paid on purchases made outside the Poles will be allowed for four years. For the Poles that are declared after the publication of the Decree, this period will begin from the entry into force of said declarations.
The productive economic activities to which it refers must have the following vocations, the Decree details:
1. electrical and electronic;
2. semiconductors;
3. Automotive (electromobility);
4. Auto parts and transportation equipment;
5. Medical devices;
6. pharmaceutical;
7. Agroindustry;
8. Electric power generation and distribution equipment (clean energy);
9. Machinery and equipment;
10. Technology of the information and communication;
eleven. Metals and petrochemicals, and
12. Any other not included in the previous sections determined by the Governing Board of the Interoceanic Corridor of the Isthmus of Tehuantepec for the Poles of Development for Well-being, in terms of the applicable legal provisions.
The Treasury explained that companies will also be able to access existing benefits in terms of foreign trade, such as VAT exemption on temporary imports of inputs, the 0% rate on the export of goods or services and administrative facilities that reduce costs.
