How to calculate the proportional part of the bonus?
If you have not been in a job for a year and you want to know how much money you are going to receive, you can calculate the proportional part of your Christmas bonus.
The first thing to do is divide the monthly salary by 30 to obtain the daily salary. For example, if a worker earns 10,000 pesos a month, per day he receives 333.33 pesos; this is multiplied by 15 and the result is: 5,000 biweekly pesos.
The next step is to divide the number of days that the worker receives -15 days, which is the minimum established by law- between the 365 days of the year. The result is 0.041; this is multiplied by the number of working days, for example, 30 days (one month). The result is 1.23.
Finally, multiply 1.23 by 333.33 -the daily salary-.
The result is 409.99 pesos that the worker will receive for a month worked in a company.
What do I do if I don’t receive a Christmas bonus?
Employers who do not comply with the payment of the Christmas bonus will be fined.
Workers have one year to make any claim related to this benefit. To do this, they can go to the Federal Labor Defense Attorney’s Office (Profedet) to receive free and personalized legal advice.
Profedet will file the corresponding lawsuit before the corresponding federal or state labor authority.
