That the burgers we receive do not look like the ones in the photos is something that we all already take for granted, but in the United States they are not willing to accept that they are also deceived with the size. Burger King is facing a lawsuit in which the chain of manipulate actual dimensions of two of its most popular hamburgers, deceiving what is shown in the ads with respect to reality.
The lawsuit was filed in March of last year 2022 and now the Miami federal judge, Roy Altman, has motion denied presented by the multinational in which it requested to dismiss the lawsuit. The judicial sentence signed by the magistrate determines that the plaintiffs can go ahead with the claims presented, leaving it to a popular jury to decide if they are right in their claims.

The prosecution alleges that the Whopper and Big King hamburgers shown in the advertisements are larger than what the consumer actually receives, claiming economic damages on behalf of four plaintiffs and the millions of people who have been able to buy the products since then. The chain is accused of breach of contract and negligent misrepresentation, demanding that the photos be replaced with others that clearly show the actual size of the burgers.
Although the judge has rejected the lawsuit’s claim that the advertising photos set up “an offer” that became part of a binding contract, because the ads do not include purchase information, the menu photos in the restaurants they do contain pricing information and specific descriptions.
“These order panels they are actually in the stores when customers walk in. Its sole purpose is to present the potential customer with an offer of the items available on the menu (and their prices),” adds the district judge.
Other fast food chains and companies have been involved in similar lawsuits in which they are accused of deceiving or misrepresenting the consumer, such as McDonald’s, Wendy’s or Taco Bell.
