One of the arguments that Televisa seeks to reinforce is that the Institute issued a resolution through an investigation that did not reflect market trends and the consumption patterns of users of the pay television service, as well as of the content platforms under demand to determine whether and to what degree a substitution or complementarity exists.
Televisa was not immediately available to comment on the matter, but one of the arguments that Televisa put forward in the challenge document on the IFT resolution is that the regulator’s investigation “is general” on the 35 markets studied and did not contemplate criteria such as user behavior patterns, demographic, socioeconomic and competition characteristics, since these vary in each of the municipalities determined as the relevant market.
The IFT will challenge the resolution that annulled its determination and the first step is the development of a new study that will allow it to demonstrate the advantage that Emilio Azcárraga’s company has in the 35 markets, without detailing whether the investigation will begin this year or if it is already done.
