One of the most important points of discussion that has taken place in Mexico in recent days is about the reduction of the Workday, where they intend to go from 48 to 40 hours a week, something that would bring many benefits for workers. In the following note, here we tell you all the details about the possible approval of this important reform and how its application would be carried out.
When does the 40-hour workday go into effect?
This project has received the support of committees, but, so far, it still awaits the most crucial approval, which must be granted by the plenary session of the Chamber of Deputies and the Senate. For the reform to become law, the support of two-thirds of legislators or a public discussion is required.
If modifications are made, they must be put to a vote and obtain the corresponding approval. If it is confirmed without alterations by both chambers, it will be sent to the Executive branch and published in the Official Gazette of the Federation for implementation.
What happens after the 40-hour work day is approved?
For the labor reform to become effective, the process begins with its approval in the Chamber of Deputies, a step that has already been completed. You must then obtain the Senate approval, which has the option to make adjustments or return it to the original camera. Finally, requires approval from at least 17 states of the Mexican Republic to be implemented.
Resolution of the working day of 40 hours per week

- The first forum took place on October 16 on the occasion of the Open Parliament on Working Time and Rest.
- The second will be a Debate on Labor Productivity and Competitiveness in Mexico and the World, scheduled for Wednesday, October 25 at 9 a.m. (Central Mexico time).
- The third will be a dialogue table that will address the Conventional Framework of the Working Day and the Reduction Model in other countriesand the Monday, November 6 at 5 p.m. (Central Mexico time).
- The last event will consist of the presentation of the conclusions of all the meetings, including the Dialogue table on Employment and Working Day, and will take place on Monday, November 13 at 5 p.m. (Central Mexico time).
What does the proposal to reduce working hours consist of?
The amendment to the Federal Labor Law aims to reform section A of article 123 of the Political Constitution of Mexico regarding days of rest and the reduction of working hours. In this sense, it is proposed:
- Reduce the work week from 48 to 40 hours.
- Provide two days of rest for every five days worked.
How is the working day established in the Constitution?
According to section A of article 123 of the Political Constitution of Mexico, two points of mandatory compliance are established (listed with Roman numerals I and IV):
- The maximum work day will be eight hours.
- Workers must have at least one day of rest for every six days of work.
