It was learned that the Second Chamber of the High Court decided unanimously to vote in favor of a project prepared by Minister Jaime Laynez Potisek, which provided for the support and protection of Ricardo Salinas Pliego’s company.
TV Azteca faces a trial for a debt with the SAT from almost 15 years ago, for around 2,636 million Mexican pesos.
On January 19, the Court had already rejected an injunction filed by Grupo Elektra against the payment of two thousand 663 million 428 thousand 880.12 Mexican pesos corresponding to ISR for the year 2006.
The Second Chamber of the Supreme Court of Justice of the Nation (SCJN) granted this Wednesday an amparo to TV Azteca so that the Federal Court of Administrative Justice (TFJA) reviews again the debt that the television station belonging to Grupo Salinas, has with the Tax Administration Service (SAT).
Let us remember that TV Azteca faces a trial for a debt with the SAT from almost 15 years ago, for around 2 thousand 636 million Mexican pesos.
According to information from the sentence, it states that “The justice of the Union supports and protects TV AZTECA, Sociedad Anónima Bursátil de Capital Variable, against the authority and the act claimed, for the purposes specified in the appealed judgment.”
It was learned that the Second Chamber of the High Court decided unanimously to vote in favor of a project prepared by the minister Jaime Laynez Potisek, who planned to support and protect Ricardo Salinas Pliego’s company.
Minister Laynez Potisek’s project explains that on April 1, 2016, the federal tax authority issued the determining resolution, in which it established a tax credit payable by TV Azteca for omitted contributions from Income Tax (ISR) updated , surcharges and fine with respect to fiscal year 2009.
“The tax authority is obliged to inform the legal representative and the company’s management bodies about the known facts and omissions,” the document adds.
On January 19, the Court had already rejected an injunction filed by Grupo Elektra against the payment of two thousand 663 million 428 thousand 880.12 Mexican pesos corresponding to ISR for the year 2006.
In this sense, Elektra considered that justice was denied to her, because the majority of the ministers of the Chamber refused to study the matter in depth, for which she reported that they will resort to international instances to challenge the decision of the Chamber.
