TikTok is still in the ‘eye of the hurricane’. After Republican Governor Greg Gianforte signed a law on May 17 to ban the use of the Chinese app, TikTok is suing the US state of Montana.
The company owned by bytedance, alleges that the ban violates the United States Constitution, including the First Amendment that protects free speech. As well as other federal laws, according to lawsuit documents filed in Montana District Court.
Gianforte said on his Twitter account “To protect the private and personal data of the highlanders of the Chinese Communist Party, I have banned TikTok”. In response to the governor’s concerns, which is the key motivation behind the ban, the app claims they are unfounded.
The new law would impose a $10,000-a-day fine on TikTok or app stores (such as the Apple App Store or Google Play) for making the app available to users in the state on or after January 1, 2024.
“We are filing a lawsuit against Montana’s unconstitutional TikTok ban to protect both our business and hundreds of users”Brooke Oberwetter, a spokeswoman for the app, said in a statement.
“We believe that our legal challenge will prevail based on an excessively strong set of precedents and facts.”
In addition to TikTok suing the state of Montana, the one filed by various influencers against the veto of the application is also added.
On the other hand, there is currently a list of countries where TikTok is prohibited.
