For the first time, Mexico will allow almost 93,000 people who are in preventive detention in the country’s 282 prisons to vote in the 2024 presidential electionsas decided this Friday by the National Electoral Institute (INE).

Until now, This was only possible at the state level and in 2021 inmates voted in the elections for federal deputies.
“This proposal contributes to the promotion, respect, protection and guarantee of the right to vote of people in preventive detention and consequently strengthens the exercise of their human rights,” said counselor Martín Faz, president of the Commission, in the session. of Training and Electoral Organization.

People who are deprived of their liberty will be able to vote in the presidential electionsbut they will do so in advance, from May 6 to 20, 2024, and in those entities that have this exercise legislated, they may also do so for local positions.
In the case of Mexico City, they will be able to vote for the head of Government, councils and mayors; in Chiapas by the governorship, councils and city councils, while in Hidalgo by municipal governments.
The INE detailed that the scrutiny and counting of the vote will be carried out at the tables approved by the district councils, while the incorporation of the results into the electoral systems will be carried out by the Institute and local public organizations according to each type of election.
Prisoners who want to participate will be included in the Nominal List, but they will not be physically given a credential and the Penitentiary Center in which they are held will be considered their address.
Since 2019, the electoral authorities organized a first pilot test to guarantee this right to this population.
This is due to the request of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF), which in 2019 resolved that people in preventive detention have the right to vote like any other citizen, although they lose this guarantee due to their legal status, according to Mexican laws.
In this sense, the INE carried out a pilot test in 2021 to guarantee this prerogative, which had a participation result of more than 94% in five Mexican penitentiary centers.
