In order to avoid collective action, Palacio de Hierro signed an out-of-court agreement with the Federal Consumer Attorney’s Office (Profeco), in which it promised to deliver a package of products to each of the affected consumers, or to pay an amount for the difference between the original price and the offered price of the package or product claimed, including the 20% bonus with respect to the offered price of the package or product; according to the Federal Consumer Protection Law.
The Federal Consumer Attorney’s Office recognized “the attitude” of El Palacio de Hierro to put its consumers as the central axis, instead of resorting to dilatory judicial instances.
