The plenary session of the TFJFA resolved the tax judgment against the owners of Interjet.
Miguel Alemán Velasco and Miguel Aleman Maganani lost their case before the SAT.
The taxes due from the airline will be settled by final resolution.
The Federal Court of Federal Justice (TFJFA) sentenced Miguel Alemán Velasco and Miguel Alemán Magnani to pay 689 million 369 thousand pesos to the Tax Administration Service (SAT) for the fiscal debt of ABC Aerolíneas (Interjet) for considering them jointly and severally liable for the withheld and unpaid taxes.
“It was proven that Mr. Miguel Alemán Velasco, since its constitution, has been part of the Board of Directors of Airlines, in his capacity as president, and Miguel Aleman Maganani, holds the position of vice president of the Board of Directors and general director of (Interjet)” , commented Carlos Mena Adame, magistrate of the TFJFA.
According to the institution, both entrepreneurs had administrative powers of ownership in the company, something that was found in the analysis of the charter of the low-cost airline, which has not operated since December 2020.
“The project that is submitted for your consideration was prepared following the criteria of the majority of the members of this plenary jurisdiction and therefore the arguments of the actors are resolved unfounded,” said the Court’s lawyer during the public resolution.
Interjet debts before the SAT
The SAT had seized the shares of Miguel Alemán Magnani’s companies, corresponding to Galem Energy Services, Turbo Ductos de México, Inmobiliaria Tilingo, Servicios Almagna and Maj Production Mexico, for an income tax debt from ABC Airlines.
“The registration of the seizure of 650 shares, which are owned by Miguel Alemán Magnani, in his capacity as jointly and severally liable for ABC Aerolíneas, is ordered”, revealed at that time the trials against the Mexican businessman.
This background was considered appropriate in the grounds that support the Court’s resolution, which dismissed the arguments of those involved by referring to Article 26 section 3 of the Federal Tax Code.
In September 2020, the bank accounts, cars and brands of the owners of Interjet were seized, after Lourdes del Ángel Palacios, from the Decentralized Administration of Collection of the Federal District 2 of the SAT, was the one designated to carry out the seizure.
Alemán Magnani was part of the Business Advisory Council of President Andrés Manuel López Obrador at the start of the six-year term and is considered a fugitive from justice for the crime of tax fraud at Interjet, since the airline that was in his charge until two years ago faces a debt 1.25 billion dollars.
In addition, this judicial resolution comes just four days after the Alemán family, a descendant of former President Miguel Alemán Valdés, announced a large auction of 150 objects that the historic politician had in Paris, France, where Alemán Magnani is known to be sheltered. along with their defense attorneys.
