The judge Yadira Elizabeth Medina Alcantarahead of the Third District Court in Administrative Matters of Mexico City imposed within 24 hours to the Ministry of Public Education (SEP) to comply with the final suspension granted in favor of the National Union of Parents, with which it was ordered stop printing new textbooks for the 2023-2024 school year.
Given the procedural status of the records, it is noted that the responsible authorities have been omitted in accrediting the corresponding efforts to comply with the definitive suspension issued on May 25, two thousand and twenty-three”, details the order of the togada whose copy it possesses HIGH LEVEL.
Consequently, given that compliance with the suspension in the amparo trial is in the public interest, and therefore mandatory, the judge required the educational authorities “so that within TWENTY-FOUR HOURS, they prove that they have complied with the suspension decreed ”. In the definitive suspension, which was granted last week, the SEP was ordered to stop the edition, printing and delivery of free textbooks for the next class period, since the National Union of Family Parents argues that the their new content was included without the federal agency having observed the legal procedures to which it is bound.
In this sense, the legislation on the matter establishes that, for any modification of the books, the SEP must guarantee the participation of parents, in addition to the intervention of state governments and educational specialists.
Since it was not verified that the SEP made these consultations to modify the free texts, the judge determined that said authority should refrain “from continuing with its edition and printing”.
The group of parents argued in their request for protection that the books They are not adapted to the current study plans and programs, and specifically challenges the constitutionality of the official texts for the basic education level, among these 5 first grade texts; 5 of a second; 2 from third grade, and 2 from fourth grade.
According to the National Union of Parents, the new textbooks, especially those related to the subject of Spanish, include an incorrect use of words.
For example, Erroneously, adding an “s” at the end of some words is endorsed, such as “you did” or “you said”. The organization also argues that the content of the books exposes a very peculiar vision of the poverty and inequality that exists in the country.
challenge without effect
Through a Complaint, the SEP challenged the provisional suspension granted by Judge Yadira Elizabeth Medina Alcántara on May 19, and obtained its revocation from the Seventh Administrative Collegiate Court of Mexico City.
Nevertheless, that ruling -which benefited the federal authority- has already been rendered null and void, because one day after the determination of the Court, the Third District Court granted the definitive suspension. Therefore, the SEP is obliged to stop printing the new textbooks, otherwise its officials can be fined and even dismissed, if the contempt is maintained.
After complying with this order, the Ministry of Public Education can challenge the definitive suspension through a Review Appeal, which must also be resolved by a Collegiate Court in Administrative Matters, although until now, according to the file consulted by HIGH LEVELthis has not happened.
