What is a tax regime?
A tax regime consists of the rights and obligations that correspond to a citizen with respect to the economic activity or activities carried out. The type of activity and income determines which tax regime must be registered.
How do I know what tax regime I am in?
To find out what tax regime you are in, you just have to do the following:
1.- Enter the following SAT website to consult tax data: https://www.cloudb.sat.gob.mx/datos_fiscales/
2.- Log in with RFC or CURP and accept the terms and conditions. To do so, you must already be registered with the SAT.
3.- Choose where you want to receive the file with your fiscal data; Can be you email (the most recommended and practical option) or your Tax Mailbox.
4.- You will receive an email in the chosen option, with a link to generate a unique file. You just have to click on the link to automatically receive a PDF file with your main tax data: name, denomination or company name, RFC, tax regime and zip code.
5.- The tax regime will be indicated with a three-digit numeric code. You must corroborate which of all corresponds to the following list:
- 601 General of Law Moral Persons
- 603 Legal Entities with Non-Profit Purposes
- 605 Wages and Salaries and Income Assimilated to Salaries
- 606 Lease
- 607 Alienation or Acquisition of Assets Regime
- 608 other income
- 609 Consolidation
- 610 Residents Abroad without Permanent Establishment in Mexico
- 611 Dividend income (partners and shareholders)
- 612 Individuals with Business and Professional Activities
- 614 Interest income
- 615 Income regime for obtaining prizes
- 616 No tax obligations
- 620 Production Cooperative Societies that choose to defer their income
- 621 Fiscal Incorporation
- 622 Agricultural, Livestock, Forestry and Fishing Activities
- 623 Optional for Groups of Companies
- 624 coordinated
- 625 Regime of Business Activities with income through Technological Platforms
- 626 Simplified Trust Regime
- 628 hydrocarbons
- 629 Of Preferential Tax Regimes and Multinational Companies
- 630 Disposal of shares on the stock market
What happens if I am in the wrong tax regime?
It is necessary to be registered in the correct tax regime to avoid these problems:
– You could be in breach of your tax obligations, which can bring you fines and penalties.
– There is a risk of having returns and incorrect payments that can be rejected. This would lead you to present them again in the appropriate tax regime.
– If there are significant discrepancies, you could be audited by the SAT and receive fines or sanctions that could even have legal consequences.
– You could lose tax benefits that the SAT grants to responsible taxpayers.
