How do you pay on December 31 and January 1?
December 31 is not contemplated as a holiday, therefore, the pay is normal. In the case of January 1, it is considered a holiday by the Federal Labor Law, so the pay is different.
The Article 75 of the Federal Labor Law establishes that on an official holiday, workers must receive “regardless of the salary that corresponds to them for the mandatory rest, a double salary for the service provided.”
For example, if a worker earns 100 pesos a day, they will be paid that amount, but will receive an additional 200 pesos, for a total of 300 pesos.
January 1, 2023 falls on a Sunday, so, according to the law, you must also receive 25% of your daily salary for the Sunday bonus.
