Thanks to a video shared on social networks, where a woman denounced the collection of a tip by a waitress, the Federal Consumer Attorney’s Office (Profeco) suspended the establishment in question.
The origin of the problem was because the worker supposedly did not let the diner and her companions out due to the 100 pesos that they left as a tip, an amount that apparently the employee did not like.
“Tipping is mandatory”, is heard in the first seconds of the video, immediately, the woman replies “no, according to the Law a tip is not mandatory, and we were going to give you 100 pesos and we couldn’t, and we don’t bring more than that”, then someone else is heard saying “we don’t bring cash”.
The talk focuses on the fact that the tip is not forced. Finally, the worker at the place tells the diner that she is recording that she will call the manager to explain why.
Due to the above, Internet users expressed their opinion about it in the comments, among the most prominent is: “a tip is never mandatory, but it is okay to reward the waiter. If they don’t pay the waiter, that’s not the customer’s anger”, “why instead of demanding a tip they don’t demand a living wage”, “with attitudes like this, you will never leave a tip anymore”.

Profeco suspends restaurant
The Profeco paid attention to the complaint that went viral about the waitress of the Train Bistro Altavista restaurant, where she prevents several diners from leaving for leaving a 100-peso tip. The federal agency suspended the establishment as a precautionary measure. However, you can continue to operate as normal.
Likewise, the institution visited the restaurant located in the San Ángel Inn neighborhood of the Álvaro Obregón mayor’s office and that it could not corroborate the collection of the tip because it was not indicated on the sales tickets, “nor was a situation found in flagrante in which the demand for an undue charge was being forced at the time the verification was made.”
However, it reported that it “detected some canned drinks with an expired expiration date” and added that “since this commercial practice affects or may affect the health of consumers, the precautionary measure of SUSPENSION was applied to that trade, which consists of placing stamps to prevent the sale of the indicated product,” the agency explained in a statement.
On the other hand, Profeco indicated that the restaurant continues to operate and that a deadline has been set to correct the irregularities found. “However, a proceeding for violations of the Federal Consumer Protection Law was initiated against him,” she said.
Derived from the constant “abuses” that have occurred in gastronomic establishments in Mexico City, the Federal Consumer Attorney’s Office, the National Chamber of the Restaurant Industry (Canirac) and the Government of the Mexican capital collaborated to implement various measures, such as the creation of the Regulation of Article 28 of the Law of Commercial Establishments for Mexico Citywhere it is established that the menu with prices (VAT included) must be displayed at the entrance.
La Profeco highlights that restaurants cannot demand a tip: “this is a voluntary gratuity and cannot be included in the account without the consent of the consumer”.
Thus, if an establishment includes it without asking, it is a practice that violates consumer rights and can be denounced.
