- The Health Advertising Law applies to any MEDICAL, HEALTH OR HEALTH advertising agency.

In Mexico, there is a Health Advertising Law, which applies to any doctor or health company that wants to promote their products. In fact, if you don’t have permission from the COFEPRIS You can NOT post on networks and you can become a creditor to a fine.
Who does it apply to?
- Advertising agency, who has as main activity the creation, design, planning and execution of advertising campaigns. As well as the contracting, by account and order of advertisers, of spaces for diffusion through the different communication media.
- Advertiser, who uses advertising to publicize the characteristics or benefits of their products and services.
- advertisement, to message to the public or to a segment thereof, with the purpose of informing about the existence or characteristics of a product, service or activity for its commercialization and sale or to motivate conduct.
- advertising campaign, to scheduled broadcast of several advertisements on the same product or service, adapted to the different media.
THE MOST IMPORTANT POINTS
ARTICLE 4. Advertising intended to be broadcast in the national territory, regardless of its origin, shall comply with the provisions of the Lawthis Regulation and other applicable provisions.
ARTICLE 5. Advertising made on offers or commercial promotions related exclusively to the price of products, services and activities will not be subject to this Regulation. But when you refer to them in a particular way or by their brands, you must include the legend that, in your case, corresponds.
ARTICLE 6. advertising will be consistent with the characteristics or specifications that establish the applicable provisions for the products or services object of the same, for which you must not:
I Attribute preventive, therapeutic, rehabilitative, nutritional, stimulating or other qualities. Which do not correspond to their function or use, in accordance with the provisions of the applicable provisions or in the authorization granted by the Secretariat.
II. Indicate or suggest that the use or consumption of a product or the provision of a service is a determining factor for change people’s behavior.
III. Indicate or lead to believe explicitly or implicitly that the product has the ingredients or the properties of which it lacks.
ARTICLE 7. Advertising will be guiding and educational regarding the product or service in question, for which it must:
I. Refer to the characteristics, properties and real jobs or recognized by the Secretariat, of the products, services and activities. In Spanish, in clear and easily understandable terms for the public to whom it is addressed.
II. Provide health information on the use of the products and the provision of the services. Which must correspond, where appropriate, to the purposes indicated in the respective authorization.
III. Point out the necessary precautions when the use, handling, storage, possession or consumption of the products or the provision of services may cause risk or damage to people’s health.
