Having a pension is what most of the people attached to the Mexican Social Security Institute (IMSS) expect after completing a number of years worked. However, for various reasons, some of them have to go back to work, but live in fear of being referred to them.
The IMSS pension will be respected as long as you meet a series of conditions, because if you do not have these parameters, the institute can stop this right.
The reasons may be: not complying with a certain number of weeks of contribution, not being in force in your rights, dying while active without minimum weeks, returning to work without notifying the IMSS or not reaching the minimum for disability pension.
There are some procedures in the IMSS procedures that generate confusion among the beneficiaries, especially in the case of workers registered in Modality 40, in order to improve their IMSS Pension to enjoy monthly payments of up to 50 thousand pesos with this model known as the Voluntary Continuation of the Mandatory Regime.
In this scheme, workers are in charge of making the respective employer contributions to an employer, covering their quotas on their own account in such a way that retirement savings are increased considerably and with the average contribution salary that aspires to greater deposits of your IMSS Pension with Modality 40.
However, if you complete the retirement process and receive payments under this program, and instead of retiring as a pensioner you decide that you still do not want to end your career, you can continue working, but in order not to lose this benefit you will have to make sure that your new employer does not register you with Social Security, so that you obtain income for your new salary without jeopardizing your earnings obtained through the public institution, especially after having made the investment through of the quotas.
You must be careful if you rejoin the labor force to improve your perceptions without stopping collecting your IMSS Pension, the precautions are not complicated, but you must attend to them to get the most out of it instead of harming your retirement plan.
Even if you already collect your IMSS Pension under Modality 40, you can work again as long as you make sure that your new employer does not register you with Social Security, since you would lose the benefit there.
Likewise, you must review your situation before the Tax Administration Service (SAT) and make the change of Tax Regime to place yourself in the Salary Regime for fees to protect your pension payment.
To carry out this procedure, the requirements that you will need are: present your valid official identification with photograph, Unique Population Registration Code (CURP) and a document in which your Social Security Number (NSS) appears. You must also have your Federal Taxpayer Registry (RFC) code on hand to make your SAT appointment.
