The Faculty of Higher Studies (FES) Aragón of the UNAM concluded that the thesis presented in 1987 by the minister of the Supreme Court, Yasmín Esquivel, is “cSubstantial opia filed in 1986 by Law School alumnusEdgar Ulises Baez.
In a statement, the institution explained that the Academic and Scientific Integrity Committee valued the “elements of construction, development, style, content, temporality, consistency and information management of both theses, as well as the analysis of the physical and digital files institutions and the documentation exhibited by the parties involved.”
In this way, the faculty would have concluded that the original thesis was the one presented in 1986 by Edgar Ulises Baez, despite the fact that Minister Esquivel insisted that she was a victim of plagiarism, despite having presented her degree work a year later.
He also indicated that heThe performance and participation of the adviser in both titling projects and a possible “lack of compliance of university ethical principles and adherence to institutional regulations.”
Both cases will be referred to the corresponding instances so that they proceed in accordance with university legislation.
According to the complaint made by the writer Guillermo Sheridan on the Latinus site, Esquivel Mossa allegedly plagiarized his thesis, called “Ineffectiveness of unions in trust workers of article 123 Section A”when defending that text in 1987, a document that has too many similarities with the essay presented in 1986 by Báez Gutiérrez.
The story supported by Esquivel Mossa, although it seems improbable, is the following: She would have started her thesis project in 1985, two years before finishing her degree, so from that date the document would have been in the possession of the teacher Martha Rodríguez Ortiz.
This in turn, in 1986, a year before Esquivel defended the thesis, would have shown the text to Édgar Ulises Báez, who was later accused of plagiarism by the Minister of the Court before the Mexico City Prosecutor’s Office.
This version is not only denied by the author of the first thesis, but also contradicts what was stated by the rector of the National Autonomous University of Mexico (UNAM), Enrique Graue Wiechers, who argued last week that in this controversy “it is evident the existence of plagiarism”.
The UNAM will not withdraw the title
Despite the fact that the plagiarism was confirmed, the National Autonomous University of Mexico (UNAM) will not withdraw the degree from Esquivel Mossa because the institution “lacks the mechanisms to invalidate a degree issued by the National University, even when the plagiarism of a thesis is documented.”
The content of the resolution of the Committee of the FES Aragón will be sent to the Secretary of Public Education (SEP) for the purposes that may arise, added the UNAM in a statement signed by the rector of the UNAM, Enrique Graue.
The rector added that the FES Aragón initiated an administrative investigation on Professor Martha Rodríguez Ortiz, who served as director of the aforementioned theses, to explain the reasons for her actions.
“Our house of studies considers that it will always be better to prevent cases as unfortunate and painful as these, so in agreement with the College of Directors of Faculties and Schools, the first measures have already been taken in this regard, as well as the study of the alternatives that allow us to strengthen our regulations to prevent issues like the one at hand”, added Enrique Graue Wiechers.
