last Monday, Lima AllianceBinacional, Cienciano del Cusco and Melgar de Arequipa received the news that the disciplinary process that was to be followed against them was annulled by the Disciplinary Commission of the Peruvian Football Federation (FPF). As a step? According to the resolution issued by said commission, its members had not given their consent or authorized the Technical Secretariat to notify the start of this procedure. The statement generated various reactions, especially from those affected.
On behalf of the blue and white club, the delegate Hector Ordonez He pointed out, through his Twitter account, that this event should generate a restructuring in the instances involved. “What happened with the false opening of a disciplinary process against four clubs, denied by the FPF Disciplinary Commission, is extremely serious and I believe it should lead to resignations from the entire Commission and General Secretariat (Dr. Sabrina Martín). There is no suitability, autonomy or independence”, said the blue and white manager.
Last Friday, June 2, the FPF Disciplinary Commission issued a resolution announcing the opening of disciplinary proceedings against Lima Alliance, scientist, binational and FBC Melgar. The motives? The General Secretariat of the highest entity of Peruvian soccer denounced these four institutions for not subscribing and ignoring the owner of the television rights of the Betsson League 1. That is, for not signing the contract with 1190 Sports. However, this Monday there was a change in the designated measures.
According to Official Letter No. 026-CD-FPF-2023 of the FPF Disciplinary Commission, published on June 5: “Declare the nullity ex officio of each and every one of the resolutions notified to the Alianza Lima, Melgar, Deportivo Binacional and Cienciano clubs, referring to requests for disciplinary measures for violation of the FPF Statutes related to the Betsson League 1 championship and to the Single Football Regulations 2018, leaving without effect the notifications sent”.
Of course, in the same document they explained that this “does not affect the processing or procedure of the complaints filed by the FPF, against the Clubs involved, which will be subject to a timely pronouncement by this Commission”. However, hours after Official Letter No. 026-CD-FPF-2023 was issued, Resolution No. 021-CD-FPF-2023 was published, where the Disciplinary Commission announced the reasons that led to the annulment of these last resolutions, specifying that “The members of this Disciplinary Commission have not given their consent nor have they authorized the Technical Secretariat to issue any resolution regarding the initiation of this procedure.”.
And, as if that were not enough, the General Secretary of the FPF, Sabrina Martín, made her own pronouncement to thus culminate the public paper. “We will take care of taking the necessary and corrective measures so that this type of event is not repeated in any of the commissions. On the other hand, the FPF reiterates its position of respect for the decisions made by the members of all the commissions, since they enjoy total autonomy and absolute independence.“, held. However, she clarified that “The nullity of these official letters will not affect the processing or procedure of the complaints presented by the General Secretariat of the FPF against the clubs involved, which will be subject to timely pronouncement by the Disciplinary Commission.”.
The fight for TV rights
The clubs Lima Alliance, Melgar, Cienciano, Binacional and Cusco FCnext to Peru Football Consortium, are in a legal battle against the Peruvian Football Federation (FPF), for the rights to broadcast their matches in League 1. The highest national football entity, through a precautionary measure, managed to have the duels of the aforementioned teams broadcast by the Liga 1 Max signal and not GOLPERU. The FPF argues that it is the owner of the broadcasting rights of the local tournament, relying on FIFA regulations that establish it, while the denounced clubs defend the extension of their link with the Consorcio Fútbol Perú (GOLPERU), appealing to the established preferential right. in said contracts.
These differences led to the blue and whites -like other clubs- not appearing on their debut (the third day of the championship) and added a ‘walk-over’, since their matches could not be broadcast on GOLPERU and they would be breaching the contract with Consortium. The Victorians defend their right to have signed with the Consortium, for revenues much higher than those offered by 1190 Sports, but the FPF He stands firm in his position.
In order not to add a second ‘WO’ and avoid relegation, Alianza Lima and the other teams in conflict with the FPF were forced to appear on the fourth date, although their matches were not broadcast by GOLPERU, due to the precautionary measure. To this day, and given the changes made by the FPF to their regulations, the four clubs allow the channel League 1 Max transmit their comparisons, awaiting a judicial decision that is favorable to them.
