Single three out of every 100 intentional homicides are resolved in Mexican criminal justice systemaccording to a report presented this Wednesday by the analysis center Mexico Evaluate.
The report also warns this year of a “clear absence” of state perspective to form or strengthen institutionsreluctance to invest in the criminal justice Y consolidate itas well as the abandonment of efforts to close the spaces of impunity and expand access to justice.
in the report “2021 Findings” the center of analysis monitors and evaluates the criminal justice system in Mexico six years after the entry into force at the national level of the reforms to the criminal justice system (SJP).
For the first time, the report included a calculation of state impunity in specific crimes, which revealed that the enforced disappearance (98.9%), the extortion (98.2%), the domestic violence (97.1%) and the homicide willful (96.9%) are the ones with the highest incidence in the country.
evidenced
Furthermore, the analysis of Mexico Evaluates He pointed out the insufficient budget for the institutions as well as the asymmetries evidenced by the distribution and work overload of the operators, which determines, “to a great extent”, that 91.8% of the crimes investigated in the country remain unpunished.
The budget does not guarantee the success of an institution, but it does condition it. Without sufficient resources, no justice institution will be able to improve its response capacity for citizens, impunity will continue to escalate and we will have an even weaker rule of law”,
commented Edna Jaime, general director of México Evalúa.
The report details that in 2021 the budget at the state level increased only 0.07% compared to 2020.
Of that budget, 50% was allocated to public security, 26% to the prosecutor’s offices, 22% to the judiciary, 2% to the defense offices and barely 0.43% to the victim assistance commissions.
In addition to this, it highlights that people who work in the institutions of the criminal justice system face a significant work overload.
Nationwide Research
In 2021, each public ministry carried, on average, 169 investigation files at the national level, each expert attended 356 requests, each public defender represented 271 people and each victim advisor 175.
On the other hand, “Findings” draws attention to the failed transition of the Attorney General’s Office, the commitment to a punitive approach through greater use of informal imprisonment and the militarization of public security.
Armed forces
Among its data, it collects that currently 94,000 elements of the Armed Forces are part of the National Strategy for Public Security, and only 29% of the National Guard personnel have certification of skills and aptitudes to perform public functions.
And it is just the National Guard, created by President Andrés Manuel López Obrador, the police force that accumulates the most complaints for human rights violations: 350 in 2020, 504 in 2021 and 255 with a cutoff to June 2022.
It is urgent to rethink priorities, strengthen institutions, dignify operators and collaborate with society to build solutions”,
Chrístel Rosales, coordinator of the justice program of México Evalúa pointed out after the presentation of the report.
