What is the difference between a holiday and a non-working day?
Holidays are mandatory rest dates that are paid and that can be compensated with another day of rest or with triple payment for the day worked that day. Meanwhile, non-working days are dates established by the Government through Supreme Decree, which must be compensated and therefore the employee must return the hours they did not work.
How much should you receive if you work on a holiday?
The National Superintendency of Labor Supervision (Sunafil) of the Ministry of Labor explains that, if you work in person or remotely on a holiday, you must receive two additional daily payments to your total remuneration for the month.
How is this remuneration calculated?
Sunafil explained that if your monthly remuneration is S/ 1,025, your daily remuneration is S/ 34.17. This is deducted by dividing your salary by 30 days (1025/30). By knowing how much you earn per day, you can calculate what your payment would be. The following would correspond to you:
- Remuneration for the work done: S/34.17
- Remuneration for the 100% surcharge: S/34.17
In total it would be S/68.34 for each holiday worked in addition to your monthly remuneration. So, if there are two holidays in the month, the calculation would be S/68.34 x 2 = S/ 136.68. At the end of the month, you will receive a total of S/1161.68. Sunafil specified that, if your employer grants you days of rest in lieu of each holiday worked, you will no longer receive the additional amount.
Is there extra pay if I work on October 9?
No, since it is not a calendar holiday. So if you have to work it is like a usual work day and there is no additional payment unlike October 8, which is a date designated as a holiday.
