For all those Mexican working women, one of the most important labor rights is maternity leavesince it aims to offer you economic protection during your pregnancy period, as well as after delivery.
In this sense, The purpose of this benefit is to validate the right to reproduction of the working womanensuring her well-being and that of her baby, while being paid what corresponds to her as an employee and maintaining her job position.

If you are affiliated with the Mexican Social Security Institute (IMSS), you can receive your payment for said disability. However, there are certain requirements to make this right valid. These are:
- To have covered at least 30 weekly contributions in a year prior to the date on which the disability payment should begin
- That the pregnancy and the possible date of delivery have been certified before the IMSS
- That the woman does not work and receive compensation for it during the periods before and after childbirth
How is disability pay calculated?
It is calculated based on the last salary registered with the Institute on the date of pregnancy certification and is paid in a single installment for the 84 days covered by the certificate of maternity disability.
The steps to follow to process maternity leave at the IMSS are:
- Attend family medical consultation from the first moment the pregnancy is known or suspected
- Once it is verified, the doctor must certify the condition and give prenatal follow-up, in addition to indicating the appointments prior to delivery
- A single disability certificate will be issued for up to 84 days (which covers the prenatal and postnatal period)
To carry out the process correctly, the documents that the Institute requests are:
- Government-issued photo ID
- Official document in which the Social Security Number of the affiliate is displayed
- Interpretation of the ultrasound study no older than five weeks
