A Mexico City judge admitted the collective action lawsuit against the ticket companies Ticketmaster and show promoter Ocesa for various breaches, reported this Friday the Federal Consumer Attorney’s Office (Profeco) of Mexico.
In a statement, Profeco indicated that last Wednesday, the Ninth District Judge in Civil Matters of the First Circuit described as admissible the class action in which 521 consumers are represented, Until now, although plaintiffs continue to be added.
Profeco recalled that in December 2022 it filed a class action lawsuit, originally on behalf of 434 consumers, against computer ticket sales companies, known as Ticketmaster and against the promoter company Operadora de Centros de Espectáculos (Ocesa), which concentrate 64.5% of entertainment services nationwide.
“The collective action derived from multiple claims from consumers that have accumulated since 2021 and to date,” said Profeco.
Among otherunilateral cancellation of tickets, breach of conditions and modalities originally offered by the providers; refusal to fully refund the amount paid including service charges and the bonus of 20% of the total cost of the ticket that by law corresponds to them.
“These situations reflect a general breach in the provision of the entertainment service regarding various musical, cultural, sporting, artistic events and recreational, violating the rights of consumers,” said Porfeco in the statement.
In addition, he pointed out that this collective action “is a watershed in the defense of the right to use, enjoy and enjoy cultural and entertainment services”, endorsing Profeco’s commitment to eradicate abuses and asymmetries by these service providers.
