The General Director of the IMSS, Zoe Robledo, highlighted that through a criterion of interpretation of the Social Security Law, issued by the Legal Directorate of the IMSS, that same-sex couples be guaranteed access to Health Insurance, Maternity and Widow’s Pension, regardless of their sexual preference or marital status.
According to the IMSS statement, During the ordinary session of the Technical Council of the IMSS, held on October 25 of the current year, the Legal Director, Antonio Pérez Fonticoba, pointed out that, in December 2009, several provisions of the Civil Code for the Federal District were reformed, among them , which enabled same-sex marriage.
The Attorney General’s Office in the framework of the constitutional reform on human rights of 2011, led to the issuance of an interpretation criterion to allow access to the aforementioned insurance to the spouse of the insured or pensioner, regardless of whether it is marriage between people of the same or different sex, a criterion that was not made extensive to other figures such as concubinage.
What must be done to access IMSS services?
According to the IMSS statement, those interested in having access to Social Security services must go to the Family Medicine Unit with the birth certificates of the children in common, in the absence of these, the insured or pensioner must go to the Unit, together with their partner, in order to state, under protest to tell the truth, that they have remained in a concubinage relationship during the 5 years prior to the date of the registration application.
