The Sixth District Court in matters of Amparo and Federal Trials in the State of Mexico granted this Monday a provisional suspension in favor of Hector Luis Palma Salazar, alias Güero Palma, because a criminal judge from the state of Guerrero has omitted to formalize the new accusation, for the crime of homicide, against the drug trafficker.
Palma Salazar, who is being held in the Altiplano maximum security prison, in the State of Mexico, He accuses in his amparo claim of being illegally withheldsince more than 72 hours have passed without a formal prison order being issued for his alleged responsibility in the homicide of nine people, in events that occurred in Iguala, Guerrero, in September 1992.
In any accusation, the constitutional term to define the legal situation of a person is 72 hours, so the provisional suspension granted by the judge Enrique Vazquez Perez orders that -in that period- the new charges against Güero Palma be formalized by a court of first instance of common law in Guerrero.
“The provisional suspension of the act claimed and its consequences is granted, for the purpose that the Court of First Instance of the Judicial District of Hidalgo, residing in the city of Iguala de la Independencia, Guerrero or, where appropriate, the various authority that act in his help, resolve the legal situation of the complainant”, specifies the suspension order in favor of Güero Palma, a copy of which he has HIGH LEVEL.
If this ruling is not complied with in a timely manner, Palma Salazar must be released.
With this, the state judge has 72 hours to comply with what the precautionary measure orders in favor of the detainee, in addition to the fact that the head of the Sixth District Court in matters of Amparo and Federal Trials of the State of Mexico imposed a period of 24 hours so that the Guerrero Court informs the date and time in which Palma was made available to that instance, “due to the execution of the arrest warrant issued” in the new criminal case.
In the same way, the first instance judge in the state of Guerrero must inform federal judge Enrique Vázquez Pérez “of the steps that he is taking in order to have the complainant legally and materially made available to him,” either through of physical or electronic means, so that, once your preparatory statement has been collected, your legal situation can be resolved within the term established in article 19 of the Constitution (72 hours).
The new accusations were notified to Palma Salazar on Wednesday of last week, when he was to be released, after a Collegiate Court of Appeals acquitted of the crime of organized crime in the form of crimes against health.
As he is now being accused of a new crime, Güero Palma must receive a formal arrest warrant from the judge in Guerrero, in order for him to start his criminal proceedings, which would have to take place in accordance with previous legislation, without a trial. orally, due to the date on which the homicides were allegedly committed.
