Until when can companies pay the bonus?
Gratuity is a work benefit that workers in private companies receive. This money is paid twice a year (July and December), and is equivalent to a salary without discounts. December 15, 2023 is the last day for collaborators to receive this money. Keep in mind that the first day is December 1. that month. Failure to do so may result in fines and other sanctions.
Who receives the bonus?
According to Law No. 27735, it states that people who meet the following requirements have the right to receive bonuses:
- All workers subject to private regime.
- In the case of small business workers, they are entitled to half a bonus (in July and December).
- Those workers who work under the agrarian regime.
- Workers of public entities under the labor regime of private activity.
Who receives the extraordinary 9% bonus?
Workers who are on the payroll and within the private regime will have a full salary as a bonus and, additionally, those affiliated with EsSalud will receive an extraordinary bonus of 9%, according to the Lima Chamber of Commerce (CCL). Meanwhile, employees who are affiliated with a Health Provider Company (EPS), the extraordinary bonus will be 6.76%.
“In accordance with Law No. 27735, a rule that regulates the granting of bonuses and provided that the worker has worked the entire semester (January – June 2023). The deadline for the payment of this benefit expires this July 15, the same date that must appear on the electronic return.”said Álvaro Gálvez, manager of the CCL Legal Center. Likewise, the CCL indicates that if workers have worked for a few months in said semester, the bonus will be equivalent to one-sixth of their salary for each month worked. Although, if in a month the worker has unjustified absences, for each one a thirtieth of the sixth to be received will be deducted.
