The National Human Rights Commission (CNDH) issued a recommendation to the general director of the IMSS, Zoé Alejandro Robledo Aburto, derived from violations of human rights to health protection, as well as access to health information , to the detriment of a person who was treated with medical negligence, attributable to public servants of the General Hospital of Zone number 3 (HGZ3) in Aguascalientes.
What is the background?
According to the CDNH statement, On August 3, 2021, a person filed a complaint with the CNDH in which he mentioned that on July 12, 2021, a victim was admitted to the aforementioned hospital for presenting anemic syndrome.
However, one day later the public servant who attended her returned her to her home. The person who filed the complaint indicated that on August 7 the victim was admitted to HGZ3 again, because she was in poor health, receiving intensive care.
However, the poor care provided caused his illness to worsen and he died on August 8, 2021. Given the above, the file was filed, the summary and clinical file of the person and other information related to the medical care provided to the victim was obtained.
Based on this, a medical opinion was issued by a CNDH medical specialist, who concluded that the victim’s condition had been delicate, for which reason she required urgent third-level treatment due to high dependence on transfusions and significant risk of complications.
However, it was not until seven days after it was prepared and its corresponding transfer was indicated that the necessary steps were taken for it, so there was unjustified delay.
The recommendation of the CNDH
The CNDH requested the general director of the IMSS to register in the National Registry of Victims the persons aggrieved in their rights and to provide immediate comprehensive reparation for the damage caused by medical negligence, which must include the compensation measure in terms of the General Law of Victims, in addition to granting the psychological and thanatological attention that they require.
Likewise, the CDNH requires that the IMSS issue a circular addressed to HGZ 3 personnel in which it urges them to take into account the pertinent prevention and supervision measures, in order to guarantee that the pertinent instances are exhausted in order to satisfy the treatments. doctors, in accordance with the provisions of national and international legislation; and that, when appropriate, they undergo the certification and recertification process before the Medical Specialty Councils to provide an adequate and professional medical service.
