The Ministry has approved the homologation for the entire national territory of the type contracts for the sale of grapes destined for their transformation and of wine for the next three campaigns -2021/2022, 2022/2023 and 2023 / 2024-, which aims to promote the stability of the wine sector and improve the transparency of commercial transactions.
The approval was published yesterday, Friday, July 28, in the Official State Gazette (BOE), a proposal made by the Interprofessional Wine Organization of Spain (OIVE), which thus offers all operators for the next three campaigns on the one hand, the approved type contract for the sale of grapes destined for its transformation into wine and, on the other, the type approved wine contract.
Among other clauses, the standard contracts establish the object, the price, the form of payment, terms of payment and delivery, quality, traceability, duration and extension, as well as the way to resolve disputes. They are voluntary and their objective is to improve the operation of transactions in the wine sector. Both models include all types and origins – with or without PDO / PGI – both in the case of the grape and wine contracts. The contracts also allow the parties to freely stipulate the quality criteria required of the product that will make up the price and include all the aspects required in the current legislation on agri-food contracting.
As a novelty with respect to previously approved standard contracts, operators may agree to the validity of this model for several seasons, a possibility with which it is intended to promote the adoption of multi-year contracts in the wine sector in order to favor the necessary stability of this sector and a better functioning in the wine value chain. The orders that regulate this approval establish a conflict resolution system through the conciliation and preview procedure offered by OIVE.
Type approved contracts. The advantages
The approved standard contract differs from other private commercial contracts in that it contains a clause for control, monitoring and surveillance of compliance, whose task falls to the Contract Monitoring Commission set up for this purpose within OIVE, so that the Operators that avail themselves of this type of contract will have a mechanism for the resolution of discrepancies between the parties.
This type of contract is a widespread practice in the agri-food sector and currently sectors such as citrus fruits or forages have approved contracts in force. The promotion of its use, in addition, will allow the obtaining of valuable aggregated information on the transactions under this modality, which will contribute to better information in the sector.
For all this, and despite the fact that these standard contracts are voluntary, the Interprofessional of wine recommends their use.
