If you plan to travel to the United States during 2023 and you are going to process your American visa, you should know that it will not be necessary to meet with a consular officer to obtain certain types of visa.
The United States Department of State announced that, in order to streamline procedures, extended the measure of exempting the in-person interview for applicants for these types of visas:
- Temporary agricultural and non-agricultural workers (H-2 visas)
- Students (F and M visas)
- Academic exchange visitors (Academic J visas)
- Professionals with specialized jobs (H-1B visas).
The measure also includes the following categories:
- Educational exchange visitors (H-3 visas)
- Transfer of executives or managers within the same company (L visas)
- People with extraordinary abilities or achievements (O visas)
- Athletes, entertainers and presenters (P visas)
- Participants in international cultural exchange programs (Q visas)
The exemption from the interview with a consular officer will apply to first-time visa applicants, as well as to those who are going to renew it.

However, the State Department clarified that consular officers may still require an in-person interview on a case-by-case basistaking into account local conditions.

Why can they deny you the visa?
- You do not have the necessary evidence to prove your return: According to the United States Citizenship and Immigration Services (USCIS) document “Grounds for Denial Under Immigration and Nationality Law,” failure to establish the right to nonimmigrant status is a of the reasons for not extending the visa. This is based on section 214(B), if a tourist visa is not the correct one for a travel plan, if the person did not demonstrate that they would use the visa correctly, or if they did not demonstrate that they have strong ties to their country of origin. Some important factors that are normally considered are work, studies and family situation.
- You are missing documents: The documentation requested depends on the visa for immigrants, which in the case of H-B1 temporary workers (Professionals with Specialized Work, Cooperative Research with the DOD and Workers of Development Projects and Haute Couture Models), must have a university degree, as well as evidence that the person has the necessary knowledge to perform the required work. While for the students, they need the academic documents that support the educational program, as well as the authorization of the school for the program.
