January 12, 2023 will be remembered for the day that “Shakira buried Piqué”, metaphorically clear. In social networks there is no talk of anything else: the Colombian singer and the Argentine producer Bizarrap have released a new single and be careful because it comes with a lot of controversy because the lyrics of the song are basically a spiteful submachine gun towards your ex. The hints of the BZRP Music Session #53which are rather direct towards Gerard Piqué, are today monopolizing headlines and publications on the Internet: “sorry if you get salty”.
In a stanza of the song, the Colombian artist mentions one of the scandals in which she has recently been involved: the trial with the Treasury in Spain for supposedly defrauding 14.5 million euros.
“You left my mother-in-law as a neighbor, with the press at the door and the debt in the Treasury. You thought you hurt me and you made me tougher. Women no longer cry, women bill”
Perhaps it is a good time to analyze the state of Shakira’s trial and how much the singer owes to the Treasury in Spain. But to fully understand the figures, we must go back to May of this year, when the Court of Barcelona endorsed the decision of the investigating judge to bring her to trial, accused of defrauding 14.5 million euros from the Treasury by pretending that she did not reside in Spain and hide income in tax havens.
Six crimes against the Treasury
The car establishes that Shakira supposedly stopped paying both the personal income tax (IRPF) and the wealth tax (IP) in Spain during 2012, 2013 and 2014 even having the “obligation to do so” as their tax residence is in this country. Since during those years he would have been living in Spain for at least 243 days in 2012, 212 in 2013 and 244 in 2014, more than what is established by law.
According to the Court, Shakira was meanwhile using a network of commercial companies and scams to pretend that these companies were listed as holders of her income, with the aim that her assets only appear in companies located in tax havenslike the Bahamas, among others.
For these reasons, the court made the decision to dismiss Shakira’s appeal against the judge’s decision and indicated that there was enough evidence to judge the artist for the complaint that the Prosecutor’s Office filed against her for six crimes against the public Treasury and in the that demands a sentence of eight years and two months in prison.
Despite the fact that the Colombian artist defends that she never settled in our country permanently until the birth of her second child, in 2015, the Prosecutor’s Office has proof that he did reside in Spain in a home purchased by the couple. And that her stays outside of Spain were of “very short duration” and for “professional reasons.”
And not only that: the Prosecutor’s Office, in addition to the eight years in prison, asks a fine of 23.8 million euros. So far, Shakira has already paid the 14.5 million that was demanded of her as well as another 3 million for her interest due to the payment moratorium. Thanks to this, the Prosecutor’s Office has applied the mitigation for damage repair, which would reduce the sentence for each of the six crimes for which she is accused. That is, in the event that she was found guilty, since none of the individual sentences would exceed two years in prison, she would be able to avoid jail.
A few months later, the Colombian singer presented her defense brief to the judge in which she alleged that her professional commitments and her “philanthropic work” led her to “travel through a multitude of countries” around the world until, at the end of 2014, , decided to establish his residence in Barcelona together with the former Barça soccer player. But since it became clear that a pact with the Prosecutor’s Office was not going to work, He has been criticizing the authorities for months Spanish. In his writing, he accuses the Tax Agency of an “excessive collection effort” and of wanting to “use it for exemplary purposes.”
A few weeks ago, the artist pointed out that, since 2011, she has paid 104 million euros in taxes worldwide, 90 million of them in Spain. And she remembers that from the first day she voluntarily returned the money that the Treasury claimed from her.
