The dissatisfied group is little more than half of around 400 retirees that make up the workforce pending compensation. With the appeal filed the payment would only go to that group of retirees, leaving more than 8,000 workers.
Fausto Guerrero, president of the Association of Retirees, Workers and Former Workers of the Mexican Aviation (AJTEAM), reports that the division in the group of retirees occurred in 2016, and the power of the lawyer who represented them was revoked, Juan Ivan Pena Neder, for “inconsistencies in his work.” Peña Neder was accused by the workers themselves of “treason” in previous years, after the bankruptcy of Mexicana de Aviación, in 2014.
The retirees of AJTEAM They obtained the embargoes on the assets in 2017, while the rest “do not have a single embargo,” says the representative. For 2019, an incident of prescription of execution of the award was filed due to lack of actions in the file, since the dissatisfied group neglected the legal work.
Its last file performance dates from May 2019, and the following performance was given until November 2022, when the president Andres Manuel Lopez Obrador reported that preparations were being made for an airline operated by the armed forces that could bear the name of Mexicana de Aviación.
According to sources close to the process, Peña Neder is the one who has led the resources that currently block the sale, and there is even a fear that the federal government will withdraw its proposal.
“They have no right because they have nothing seized, and, furthermore, their right is prescribed for having abandoned the trial for three years,” Guerrero told Expansion. “It looks like a opportunistic stance of this lawyer who had abandoned the trial, and that once he knows that he knows that there is money, he jumps into the public light and begins to exercise legal resources to pretend to take possession of everything ”.
Eduardo Barrera, president of the Mexicana de Aviación delegation of the Aviation Pilots Union Association (ASPA) of Mexico, assures that it was the AJTEAM group that actively participated to reach an agreement for the sale of federal government assets.
“This lawyer, seeing that this solution is coming with the possibility of a sale guarantee, raised his hand and said: ‘We are from here,'” he warns.
The next March 13 The workers await a hearing where it will be determined whether the amparo proceeds and under what effects.
For now, the situation has not had any effect on the federal government’s offer, but the organizations fear that this could change in the coming weeks, as President López Obrador seeks to implement the armed forces airline later this year.
“If we prolong these trials, it could take several to resolve; Within five or 10 years, assets that today are worth 817 million pesos may not even be worth a quarter of them,” concludes Guerrero.
