The new Supreme Court ruling would revoke the 1973 decision that up to now grants it a federal constitutional protection of the right to abortion in the United States.
That ruling from the 1970s and another from 1992 (Planned Parenthood v. Casey) are the basis of the legal structure that has maintained current law.
“Roe v. Wade was a blunder from the start.” says the new ruling to which Politico had access.
“We understand that [los fallos de] Roe and Casey must be annulled”, says the text that is producing the rise of tens of thousands of voices to the contrary in the United States.
“It is time to comply with the Constitution and return the issue of abortion to the elected representatives of the people,” expands the ruling that would be released in the coming weeks.
If confirmed, the decision would be the most important step backwards in terms of reproductive rights in the history of the United States, say organizations linked to abortion rights from different parts of the world.
In the facts, the decision will end 50 years of federal constitutional protection and leave it up to each state (and each governor) whether or not (and to what degree) abortion is enabled.
Politico clarifies that the text is already agreed upon, but that “there may still be modifications” because it is still a draft.
It is expected that about two months will pass until the final decision is known.
How every court judge would vote on abortion rights in the United States
According to the American media, five judges, Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, Amy Coney Barrett and Samuel Alito, who wrote the text, are aligned with the decision to reverse the federal legal umbrella for abortion in the USA.
The three judges of the most liberal ideology of the Supreme Court, Stephen Breyer, Sonia Sotomayor and Elena Kagan, would be preparing a dissenting text.
It remains to be seen how the president of the highest court of the United States, John Roberts, would vote: if he will join any of the votes or if he will write his own.
How did this new story begin?
This process began when at the beginning of last year the Supreme Court of the United States agreed to analyze a case presented by the state of Mississippi that seeks to prohibit abortion in almost all its grounds after the 15th week of pregnancy.
If the draft that Politico agreed to is approved, the Court would be ruling in favor of Mississippi.
Other conservative states in the United States, such as Texas and Oklahoma, joined forces to restrict and even ban abortion in most cases.
