The former Secretary of Social Development, Rosario Robles Berlanga, obtained an amparo that cancels an arrest warrant against him for the crimes of operations with resources of illicit origin (money laundering) and organized crime, accusations made since October 2020 by the Attorney General of the Republic (FGR), derived from the corruption scheme called the Master Scam.
The Fourth District Court in Matters of Amparo and Federal Trials in the State of Mexico determined in the judgment that the FGR, and the District Judge who issued the arrest warrant, did not adequately substantiate the two crimes imputed to Robles, Therefore, the arrest warrant must be rendered insubsistent (cancelled).
When granting the amparo, the judge Eutimio Ordonez Gutierrez considered that the arrest warrant against the also former head of the Secretary of Agrarian, Territorial and Urban Development (Sedatu), “did not comply with the legal and constitutional requirements” that must be compulsorily observed in this type of warrants, among them “the precision of the place, time and circumstances of execution” of the crimes.
“This amparo judge observes that the act claimed (the arrest warrant) is not sufficiently founded and motivated in terms of the existence of the illegal act of operations with resources of illegal origin,” the ruling, which has an extension of 98 pages, specifies. whose copy you own HIGH LEVEL.
In the arrest warrant against Robles Berlanga, which was issued on October 31, 2020 based on a request from the FGR, only “generic reference is made to the signing of contracts” between the Ministry of Development Social and several universities, but “there is no clarity regarding which agreements and contracts updated the crime” of money laundering.
With this protection, the most serious accusation against Rosario Robles is eliminated, retaining only two charges for improper exercise of functions, also allegedly committed in the Master Scam.
For this last crime, the former official was in justified preventive detention from August 19, 2019 until August 22, 2022, when she obtained her conditional release.
The FGR has requested in this criminal process that the former Secretary of State be sanctioned with 21 years in prison, the maximum penalty for the improper exercise of functions, since the Federal Public Ministry argues that the affectation to the public treasury amounts to about 5,000 million pesos.
According to the Prosecutor’s Office, Robles Berlanga allegedly failed to comply with her obligations as a public servant by entering into various agreements with universities, despite the fact that when they were hired, they did not have the experience and adequate infrastructure to execute various social programs in the administration. of today’s former president Enrique Peña Nieto.
For these same facts, the FGR also wanted to prosecute Rosario Robles, but accusing her of money laundering and organized crime, which has been canceled with the amparo granted by the Fourth District Judge in Matters of Amparo and Federal Trials in the State of Mexico.
