Four hours after the Plenary of the Supreme Court of Justice of the Nation (SCJN) invalidated -for being unconstitutional- an agreement issued in 2021 by the president Andres Manuel Lopez Obrador, in which all the infrastructure projects of the current administration were considered as national security works, challenging the country’s highest court, the president issued Thursday afternoon a new decree in the same terms as the previous one.
The document, published in an evening edition of the Official Gazette of the Federation (DOF), determines that They are of national security and public interest. the construction, operation, maintenance, operation” and transport infrastructure of the Mayan Train, the Interoceanic Corridor of the Isthmus of Tehuantepec, and the airports of Palenque, Chiapas, in addition to those of Chetumal and Tulum, in Quintana Roo.
López Obrador’s decree, which enters into force this Thursday, argues that the federal government understands national security “as an indispensable condition to guarantee the integrity and sovereignty” of the country.
According to the president, the concept of national security “must be understood from a strategic perspective, because it will try (sic) anticipate risks and threats”.
Therefore, “National Security implies the management of collective well-being, the full exercise of civic liberties and the establishment of conditions of justice, peace and security, which promote prosperity and sustainable development for the nation”, adds the decree. .
Because Mexico is one of the countries with the largest territorial extension and the eleventh most populous country in the world, the document says, “It is exposed to multiple risks and threats, such as, among others, uncontrolled migratory flows, organized crime, government corruptionclimate change, disruptive phenomena, collapse of strategic facilities or critical information infrastructure, and southern and northern border problems”.
For this reason, despite the fact that the Supreme Court determined that the infrastructure works cannot be classified as national security, since that violates the Constitution, López Obrador reiterates said condition for the Mayan Train, the Tehuantepec Isthmus Corridor, and the aforementioned air terminals.
